1. Scope of application

1.1 These General Terms and Conditions (the "General Terms") apply to all transactions of products or services purchased from Swiss3DFusion. These General Terms apply at the time of the order, deviating, supplementary or conflicting terms and conditions of the customer do not become part of the contractual relationship between Swiss3DFusion and the customer and are expressly rejected by Swiss3DFusion, unless Swiss3DFusion has expressly recognized them and permitted their inclusion. 2. Delivery

2.1 Unless otherwise stated, Swiss3DFusion delivers the ordered Swiss3DFusion products ex works (EXW, according to Incoterms 2024). The place of fulfillment for the delivery of the goods owed by Swiss3DFusion is the address of the warehouse of Swiss3DFusion.

2.2 The place of fulfillment for any warranty claims is the same place as for the delivery.

2.3 If the Customer requests the shipment of the goods to a place other than the place of performance, the risk of accidental loss, accidental deterioration or delay shall pass to the Customer or the subsequent carrier (forwarder) as soon as the goods are ready for collection by the forwarder or the Customer, in the case of collection by the Customer, at the warehouse depot. If the customer is in default of acceptance, the risk of accidental loss, accidental deterioration or delay shall pass to the customer.

2.4 If the customer is in default of acceptance or if the delivery is delayed for reasons for which the customer is responsible, Swiss3DFusion can demand compensation for the resulting damage as well as the additional expenses incurred to fulfill the order. This also includes the storage and maintenance of Swiss3DFusion products.

3. Delivery time

3.1 The estimated delivery time of an order will be communicated by Swiss3DFusion upon acceptance of the order. Unless expressly stated otherwise, such estimated delivery time does not constitute a binding commitment for an exact delivery date.

3.2 From time to time, circumstances beyond the control of Swiss3DFusion and for which Swiss3DFusion is not responsible may prevent delivery in accordance with the estimated delivery time. Swiss3DFusion may notify the customer in the event of such circumstances using the contact information provided with the order. In the event of a lack of availability, Swiss3DFusion will inform the customer of a new estimated delivery time. If the Swiss3DFusion products originally ordered are no longer available, Swiss3DFusion may offer to supply an equivalent good or service. If the customer does not agree with the replacement delivery of the Swiss3DFusion products or if the Swiss3DFusion products are not available in the new delivery time, both parties can withdraw from the contract.

3.3 Swiss3DFusion is entitled to make partial deliveries if a part of the ordered Swiss3DFusion products is not immediately available, unless the partial delivery is not of reasonable benefit to the customer.

3.4 Notwithstanding the relevant statutory provisions, the customer is obliged to inform Swiss3DFusion of any delay in delivery so that Swiss3DFusion is in default.
